第一章 总 则
第一条 为贯彻落实中央组织部等七部委印发的《关于支持海南开展人才发展体制机制创新的实施方案》和《海南自由贸易港全方位引进培养用好人才的若干政策措施》等文件精神,建立健全高层次人才认定和服务管理体系,加快引进培养海南自由贸易港建设需要的高层次人才,根据有关政策规定,制定本办法。
第二条 本办法所称高层次人才,是指具有认定权限的部门、单位依据《海南自由贸易港高层次人才分类标准》(以下简称《分类标准》)和本办法认定的A、B、C、D、E类人才。高层次人才分为全职高层次人才和柔性高层次人才。
全职高层次人才一般是指人事、档案等关系在海南省或与海南各类用人单位签订3年及以上劳动(聘用)合同,并在海南省参加城镇职工基本养老保险等社会保险或缴纳个人所得税的高层次人才。
柔性高层次人才一般是指与海南各类用人单位签订2年及以上服务协议且已在海南服务满3个月,通过顾问指导、短期兼职、对口支援、退休返聘等方式为海南省经济社会发展提供智力支持的高层次人才。
第三条 《分类标准》由各有关省级行业主管部门负责拟订,并根据经济社会发展和人才需求状况适时调整;省委人才工作领导小组办公室(以下简称“省委人才办”)核准后统一动态发布。
第四条 高层次人才认定坚持德才兼备、公平公正、权责统一原则。
第二章 认定对象与条件
第五条 高层次人才认定对象不受国籍、户籍限制。
第六条 在职公务员、参照公务员法管理人员、现役军人不列为认定对象。
第七条 高层次人才应当具备以下基本条件:
(一)遵守中华人民共和国宪法和法律法规;
(二)有良好的职业道德;
(三)能力、业绩、贡献突出;
(四)个人(含曾创办企业)信用记录良好,未被列入失信联合惩戒对象;
(五)符合《分类标准》或具备相当的条件。
第八条 全职高层次人才认定对象应为未退休人员(入选“银发精英”引进项目的人选除外)。柔性高层次人才认定对象,A类应在75周岁(含)以下,B、C类应在70周岁(含)以下,D、E类应在65周岁(含)以下。特别急需紧缺的,经市县人民政府或省级行业主管部门推荐,可适当放宽年龄限制。
第三章 认定权限与程序
第九条 高层次人才认定申请常年受理。
第十条 市县、自贸港重点园区按照《分类标准》,负责本区域内高层次人才认定。人才数量密集、管理基础较好的省直(中直驻琼)事业单位、企业以及省级法定机构等单位可根据需要和有关规定申请高层次人才认定权限,经省人力资源开发局审核、报省委人才办同意后,在权限范围内按照《分类标准》自主开展本单位的高层次人才认定。省委人才办对具有认定权限的用人单位实行动态清单管理。
第十一条 高层次人才认定按以下程序办理:
(一)个人申报。个人对照《分类标准》,选择申请认定类别,通过海南政务服务网(“海易办”政务服务系统)下载并填写《海南自由贸易港全职高层次人才认定申请表》或《海南自由贸易港柔性高层次人才认定申请表》,备齐有关证明及真实性承诺材料,向所在单位提出认定申请。
(二)审核和认定。所在单位对申报人品德、贡献、业绩等条件以及申报材料的完整性、合法性、真实性进行审核把关,出具审核意见并在本单位公示5个工作日。公示期满无异议的,所在单位通过海南政务服务网(“海易办”政务服务系统),将审核意见、申报材料和公示情况报属地市县、自贸港重点园区,由属地市县、自贸港重点园区进行认定,并将认定意见和申报材料报省人力资源开发局。具有认定权限的用人单位,在海南政务服务网(“海易办”政务服务系统)中按权限自主进行认定,并将认定意见和申报材料报省人力资源开发局。
(三)备案和发证。省人力资源开发局对符合条件的人才予以备案,并颁发相应的高层次人才证书和“天涯英才卡”。
第十二条 对《分类标准》未纳入,但具备A、B、C、D、E类人才标准相当条件的人才可申请综合研判认定。
具有认定权限的用人单位,可自行组织业内权威专家论证并作出认定类别推荐意见,报省级行业主管部门审核后,由省级行业主管部门提请省委人才办会议审议。
不具有认定权限的用人单位可提出申请,经属地市县、自贸港重点园区报省级行业主管部门,在省级行业主管部门组织业内权威专家论证并作出认定类别推荐意见后,由省级行业主管部门提请省委人才办会议审议。
会议审议通过后按第十一条程序办理。
第十三条 市县、自贸港重点园区以及具有认定权限的用人单位,应制定高层次人才认定相关的制度、流程,报省人力资源开发局备案后实施。
负责高层次人才综合研判审核、论证、推荐的省级行业主管部门应当建立完备的操作规程,报省委人才办同意后实施。
承担高层次人才认定管理工作的市县、自贸港重点园区、用人单位以及省级行业主管部门,应配备1名正式工作人员负责管理日常认定工作。
第十四条 高层次人才认定从受理到办结一般应在10个工作日内完成。认定过程中对相关证书等材料的核查核验,以国家或者省级行业主管部门指定的网站信息或者有效的证明材料为准。认定过程中有存疑事项影响认定结论的,省人力资源开发局、省级行业主管部门、市县、自贸港重点园区可采取函询、实地走访等方式核查核验。确需核查核验的,高层次人才认定办理时间可适当延长。
第十五条 高层次人才认定后,达到更高类别认定条件的,可以按规定申请认定相应人才类别。
第四章 认定管理
第十六条 经认定的高层次人才,在有效期内按照有关规定享受相应服务保障待遇。入选“银发精英”引进项目的人选,可按规定享受相应全职高层次人才服务保障待遇。
第十七条 高层次人才认定的有效期不得超过劳动(聘用)合同或服务协议签订的截止时间,且最长不超过5年,有效期满前3个月内,可以申请重新认定。没有继续认定的,不再享受相关服务保障待遇。
第十八条 在琼全职工作15年以上的高层次人才,在认定有效期内退休的,不需再作认定,由省人力资源开发局核实后,按照最后一次认定的人才类别,凭相应的高层次人才证书,继续按规定享受相关服务保障待遇。
第十九条 省人力资源开发局负责建设、管理和维护海南政务服务网(“海易办”政务服务系统)高层次人才认定服务管理模块,定期对认定的高层次人才信息数据进行综合统计、对比分析、动态监测,并按要求填报相关信息数据。
第二十条 省委人才办会同省人力资源开发局应当加强事中事后监管,通过“线上+线下”方式常态化开展检查指导。每年采取“双随机”模式至少开展1次对市县、自贸港重点园区、用人单位和认定有效期内高层次人才的现场检查,规范认定工作,掌握高层次人才履职等情况。
市县、自贸港重点园区、用人单位应动态跟踪,掌握所认定高层次人才工作(服务)、参加社会保险、缴纳个人所得税等情况。用人单位应当建立高层次人才日常管理制度,配合做好监督抽查工作,及时报告有关情况。
第二十一条 高层次人才出现下列情形之一的,用人单位应当在10个工作日内向省人力资源开发局书面报告:
(一)辞职、辞退等原因离开本单位的;
(二)违反规定出国(境)逾期不归的;
(三)违背职业道德或公序良俗造成不良影响的;
(四)申报人存在提供虚假材料骗取高层次人才认定资格的;
(五)学术、业绩等弄虚作假被有关部门查处的;
(六)受党内严重警告或政务记大过以上处分,且仍处于影响期内的;
(七)受到刑事处罚的;
(八)其他不宜保留高层次人才资格的情形。
用人单位未按规定如实报告,责令限期整改;情节严重的,约谈其负责人。
第二十二条 经核实,高层次人才有本办法第二十一条(二)、(三)、(四)、(五)、(六)、(七)情形之一的,全职高层次人才在认定有效期内与申报认定单位终止劳动(聘用)合同、离开海南赴省外工作的,由省人力资源开发局注销其高层次人才证书和“天涯英才卡”,并终止其享受的相关服务保障待遇;有本办法第二十一条(八)情形的视情节进行处理。
高层次人才有本办法第二十一条(四)、(五)情形之一的,依据《海南自由贸易港个人诚信积分管理办法》处理,并且5年内不再受理认定申请,其享受到的相关服务保障待遇由提供单位负责追回。
第二十三条 对于高层次人才证书到期、注销、换发等情形,省人力资源开发局应在其官方网站,并同步在“海南自由贸易港人才工作网”向社会公告(涉密人员除外)。
第二十四条 有关单位或个人有下列情形之一的,给予相应处理,并在省人力资源开发局官方网站、“海南自由贸易港人才工作网”公告。
(一)市县、自贸港重点园区、具有认定权限的用人单位,存在对申请材料审核把关不严、不按程序认定、作出的认定意见与实际不符、无正当理由超期限办理等情形的,在全省通报;情节严重的,取消认定权限,5年内不再授权。
(二)用人单位协助申报人提供虚假证明或材料的,在全省通报;情节严重的,暂停申报资格,责令限期整改;构成犯罪的,由司法机关依法追究责任。
(三)服务中介或个人协助申报人提供虚假证明或者作出虚假审核(认定)意见的,依据《海南自由贸易港个人诚信积分管理办法》处理,并在全省通报;构成犯罪的,由司法机关依法追究责任。
(四)省级行业主管部门在履行高层次人才认定职责过程中,存在滥用职权、弄虚作假等情形的,在全省通报;情节严重的,由纪检监察机关、司法机关依规依纪依法追究责任。
第五章 附 则
第二十五条 本办法由省委人才工作领导小组办公室负责解释,具体工作由省委人才发展局、省人力资源开发局共同承担。
第二十六条 本办法自发布之日起施行,《关于海南省柔性引进高层次人才认定有关事项的通知》(琼人才局通〔2019〕62号)废止。
Management Measures for the Recognition of High-level Talents in Hainan Free Trade Port
Chapter 1 General Provisions
Article 1 In order to implement the spirit of the "Implementation Plan for Supporting Hainan in the Innovation of Institutional and Mechanisms of Talent Development" issued by the Central Organization Department and seven ministries and commissions, and the "Several Policies and Measures for the Comprehensive Introduction and Cultivation of Talents in Hainan" issued by the Central Organization Department and seven ministries and commissions, establish and improve a high-level talent recognition and service management system, and accelerate the introduction and training of high-level talents needed for the construction of Hainan Free Trade Port, these measures are formulated in accordance with relevant policies and regulations.
Article 2 The high-level talents referred to in these Measures refer to the A, B, C, D, and E talents recognized by departments and units with the authority to identify the authority based on the "Hainan Free Trade Port High-level Talent Classification Standards" (hereinafter referred to as the "Classification Standards") and these Measures. High-level talents are divided into full-time high-level talents and flexible high-level talents.
Full-time high-level talents generally refer to high-level talents who have signed labor (employment) contracts with various employers of Hainan Province or have 3 years or more, and have participated in social insurance such as urban employees' basic pension insurance or paid personal income tax in Hainan Province.
Flexible high-level talents generally refer to high-level talents who have signed service agreements with various employers in Hainan for 2 years or more and have served in Hainan for 3 months, and provide intellectual support for Hainan's economic and social development through consulting guidance, short-term part-time jobs, counterpart support, retirement and re-employment.
Article 3 The Classification Standards are formulated by relevant provincial industry authorities and adjusted in a timely manner according to economic and social development and talent demand; the Office of the Provincial Party Committee Talent Work Leading Group (hereinafter referred to as the "Provincial Party Talent Office") will be released in a unified and dynamic manner after approval.
Article 4: The recognition of high-level talents adheres to the principles of both moral integrity and ability, fairness and justice, and unity of rights and responsibilities.
Chapter 2 Determination of Objects and Conditions
Article 5 The targets for high-level talents are not subject to nationality and household registration restrictions.
Article 6: In-service civil servants, managers in accordance with the Civil Servants Law, and active-duty soldiers shall not be listed as the targets for identification.
Article 7 High-level talents should meet the following basic conditions:
(1) Comply with the Constitution and laws and regulations of the People's Republic of China;
(2) Have good professional ethics;
(3) Outstanding ability, performance and contribution;
(4) Individuals (including those who have founded a business) have good credit records and are not included in the joint punishment for breach of trust;
(5) Meet the Classification Standards or meet the equivalent conditions.
Article 8 The target of full-time high-level talents should be unretired personnel (except those selected for the "Silver Elite" introduction project). For flexible high-level talents, Class A should be under 75 years old (inclusive), Class B and C should be under 70 years old (inclusive), and Class D and E should be under 65 years old (inclusive). In case of special urgent need and scarcity, age restrictions may be appropriately relaxed after recommendation from municipal and county people's governments or provincial industry authorities.
Chapter 3: Authorization and procedures
Article 9 Applications for high-level talent recognition are accepted year-round.
Article 10: Cities, counties and key parks of free trade ports are responsible for the recognition of high-level talents in the region in accordance with the "Classification Standards". Provincial (central-directed central government) institutions, enterprises, provincial-level statutory institutions and other units with a strong number of talents and a good management foundation may apply for high-level talent recognition authority according to needs and relevant regulations. After review by the Provincial Human Resources Development Bureau and approval by the Provincial Party Committee Talent Office, the high-level talent recognition of the unit shall be independently carried out within the scope of authority in accordance with the "Classification Standards". The Provincial Party Committee Talent Office implements dynamic list management for employers with recognition authority.
Article 11 The recognition of high-level talents shall be handled in accordance with the following procedures:
(1) Personal declaration. Individuals will select the application and certification category in accordance with the "Classification Standards", download and fill out the "Hainan Free Trade Port Full-time High-level Talent Certification Application Form" or the "Hainan Free Trade Port Flexible High-level Talent Certification Application Form" through the Hainan Government Service Network ("Haiyi Office" Government Service System), prepare relevant certificates and authenticity commitment materials, and submit a certification application to your unit.
(2) Review and recognition. The unit will review and check the applicant's morality, contribution, performance and other conditions as well as the integrity, legality and authenticity of the application materials, issue review opinions and publicize them in the unit for 5 working days. If there is no objection to the public announcement period after the public announcement period, the unit will report the review opinions, application materials and publicity to the local cities and counties and key parks of the Free Trade Port through the Hainan Government Service Network ("Haiyi Office" Government Service System), and will be certified by the local cities and counties and key parks of the Free Trade Port, and the recognition opinions and application materials will be reported to the Provincial Human Resources Development Bureau. Employers with recognition authority shall independently determine the authority based on their authority in the Hainan Government Service Network ("Haiyi Office" Government Service System), and submit the recognition opinions and application materials to the Provincial Human Resources Development Bureau.
(3) Registration and issuance of certificates. The Provincial Human Resources Development Bureau will file the qualified talents and issue corresponding high-level talent certificates and "Tianya Talent Cards".
Article 12 Talents who have not included the Classification Standards but have the same requirements as the A, B, C, D, and E talents standards can apply for comprehensive analysis and certification.
Employers with identification authority may organize authoritative experts in the industry to conduct demonstrations and make recommendations for identification categories. After reporting to the provincial industry competent department for review, the provincial industry competent department shall submit it to the Provincial Party Committee Talent Office for review.
Employers who do not have the authority to identify may apply. After the provincial industry authorities have submitted them to the provincial industry authorities for deliberation after the provincial industry authorities organize authoritative experts in the industry and make recommendations for the recognition category, the provincial industry authorities shall submit them to the Provincial Party Committee Talent Office for review after the provincial industry authorities organize authoritative experts in the industry and make recommendations for recognition categories.
After the meeting reviews and passes, it shall be handled in accordance with the procedures in Article 11.
Article 13: Cities and counties, key parks of the Free Trade Port, and employers with recognition authority shall formulate systems and procedures related to the recognition of high-level talents and submit them to the Provincial Human Resources Development Bureau for filing and implement them.
Provincial industry authorities responsible for comprehensive analysis, review, demonstration and recommendation of high-level talents shall establish complete operating procedures and implement them after approval by the Provincial Party Committee Talent Office.
Cities and counties that undertake the management of high-level talent recognition and management, key parks of the Free Trade Port, employers and provincial industry authorities should be equipped with a formal staff member to be responsible for managing daily recognition work.
Article 14 The recognition of high-level talents should generally be completed within 10 working days from acceptance to completion. The verification and verification of relevant certificates and other materials during the certification process shall be based on the website information or valid supporting materials designated by the national or provincial industry authorities. If there are any doubtful matters that affect the recognition conclusion during the identification process, the Provincial Human Resources Development Bureau, provincial industry authorities, cities and counties, and key parks in the Free Trade Port can verify and verify through letter inquiries and on-site visits. If it is really necessary to verify, the processing time for high-level talent recognition can be appropriately extended.
Article 15 After high-level talents are recognized and if the conditions for higher-level identification are met, they may apply to identify the corresponding talent category according to regulations.
Chapter 4 Identification Management
Article 16 High-level talents recognized shall enjoy corresponding service guarantee benefits in accordance with relevant regulations during the validity period. Those who are selected for the "Silver Elite" introduction project can enjoy the corresponding full-time high-level talent service guarantee benefits according to regulations.
Article 17 The validity period of high-level talent recognition shall not exceed the deadline for signing the labor (employment) contract or service agreement, and shall not exceed 5 years. You may apply for re-recognition within 3 months before the expiration of the validity period. Those who have not continued to be recognized will no longer enjoy relevant service guarantee benefits.
Article 18 If high-level talents who have worked full-time in Qiong for more than 15 years retire within the validity period of the recognition, they will not need to be recognized again. After verification by the Provincial Human Resources Development Bureau, they will continue to enjoy relevant service guarantee benefits in accordance with the regulations based on the corresponding high-level talent certificate according to the last recognized talent category.
Article 19 The Provincial Human Resources Development Bureau is responsible for the construction, management and maintenance of the high-level talent certification service management module of Hainan Government Service Network ("Haiyi Office" Government Service System), regularly conducts comprehensive statistics, comparative analysis, and dynamic monitoring of the recognized high-level talent information data, and fills in relevant information data as required.
Article 20 The Provincial Party Committee Talent Office, together with the Provincial Human Resources Development Bureau, shall strengthen on-site and post-event supervision and conduct regular inspection and guidance through the "online + offline" method. Every year, the "double random" model is adopted to carry out on-site inspections of cities and counties, key parks of the Free Trade Port, employers and high-level talents during the validity period, standardize the recognition work, and master the performance of high-level talents.
Cities and counties, key parks and employers of the Free Trade Port should follow up dynamically to grasp the work (services) of recognized high-level talents, participation in social insurance, and payment of personal income tax. Employers should establish a daily management system for high-level talents, cooperate with supervision and random inspections, and report relevant situations in a timely manner.
Article 21 If a high-level talent encounters one of the following situations, the employer shall report in writing to the Provincial Human Resources Development Bureau within 10 working days:
(1) Leave the unit because of resignation, dismissal, etc.;
(2) Those who go abroad in violation of regulations and fail to return after the deadline;
(3) Violating professional ethics or public order and good customs has adverse effects;
(4) The applicant provides false materials to defraud high-level talent qualifications;
(5) Fraudulent academic, performance, etc. are investigated and punished by relevant departments;
(6) Those who are subject to serious warnings within the Party or have a serious demerit or above in the impact period;
(7) Criminal punishment;
(8) Other situations where high-level talents are not suitable.
If the employer fails to report truthfully as required, he shall be ordered to make rectification within a time limit; if the circumstances are serious, he shall be interviewed by the person in charge.
Article 22 If high-level talents have one of the circumstances in Article 21 (2), (3), (4), (5), (6) and (7) of these Measures, and if full-time high-level talents terminate their labor (employment) contract with the application and certification unit within the validity period of the recognition, they shall be cancelled by the Provincial Human Resources Development Bureau and the "Tianya Talent Card" and terminate the relevant service guarantee benefits they enjoy; if the circumstances in Article 21 (8) of these Measures are handled according to the circumstances.
If high-level talents have one of the circumstances of Article 21 (4) and (5) of these Measures, they shall be handled in accordance with the "Regulations on the Management of Individual Integrity Points of Hainan Free Trade Port", and no longer accept the certification application within 5 years. The relevant service guarantee benefits they enjoy shall be recovered by the provider.
Article 23 Regarding the expiration, cancellation, and renewal of high-level talent certificates, the Provincial Human Resources Development Bureau shall announce to the public on its official website and simultaneously on the "Hainan Free Trade Port Talent Work Network" (except for confidential personnel).
Article 24 If the relevant units or individuals have any of the following circumstances, they shall be subject to corresponding treatment and shall be announced on the official website of the Provincial Human Resources Development Bureau and the "Hainan Free Trade Port Talent Work Network".
(1) If the city, county, key park of the free trade port, and employers with identification authority fail to strictly review and control the application materials, fail to determine according to procedures, make the identification opinions that are inconsistent with the actual situation, and handle the deadline without justifiable reasons, they shall be notified throughout the province; if the circumstances are serious, the identification authority shall be cancelled and the authorization will no longer be authorized within 5 years.
(2) If the employer assists the applicant in providing false certificates or materials, it shall be notified throughout the province; if the circumstances are serious, the application qualification shall be suspended and the rectification shall be ordered within a time limit; if the crime constitutes a crime, the judicial organ shall hold it accountable in accordance with the law.
(3) If a service intermediary or individual assists the applicant in providing false certificates or making false review (determination) opinions, it shall be handled in accordance with the "Regulations on the Management of Personal Integrity Points of Hainan Free Trade Port" and reported throughout the province; if a crime is constituted, the judicial organ shall hold him accountable in accordance with the law.
(4) If the provincial industry authorities abuse their power or commit fraud in the process of performing their duties of identifying high-level talents, they shall be notified throughout the province; if the circumstances are serious, the discipline inspection and supervision agencies and judicial agencies shall be held accountable in accordance with regulations, discipline and law.
Chapter 5 Attachment
Article 25: The Office of the Provincial Party Committee’s Talent Work Leading Group shall be responsible for interpreting these Measures, and the specific work shall be jointly undertaken by the Provincial Party Committee’s Talent Development Bureau and the Provincial Human Resources Development Bureau.
Article 26 This Measures shall come into effect on the date of its publication, and the "Notice on Matters Related to the Recognition of Flexible Introduction of High-Level Talents in Hainan Province" (Qiong Talent Bureau Tong [2019] No. 62) will be abolished.
