海南自由贸易港邮轮管理若干规定

(2024年12月28日海南省第七届人民代表大会常务委员会第十五次会议通过)

    第一条 为了规范海南自由贸易港邮轮市场秩序,促进海南自由贸易港邮轮经济安全健康发展,根据《中华人民共和国海南自由贸易港法》,遵循《中华人民共和国海商法》、《中华人民共和国国际海运条例》、《国内水路运输管理条例》等法律、行政法规的基本原则,结合海南自由贸易港实际,制定本规定。

    第二条 在五星红旗邮轮投入海南自由贸易港邮轮港口运营海上游航线前,中资邮轮运输经营者可以依照本规定在海南自由贸易港邮轮港口开展中资方便旗邮轮海上游业务(以下简称海上游业务)。外籍邮轮可以依照本规定运营仅涉及海南自由贸易港邮轮港口的多点挂靠业务(以下简称多点挂靠业务)。

    本规定所称的海上游业务,是指中资方便旗邮轮从海南海口、三亚邮轮港出发,在经批准的水域范围内进行海上巡游,期间不停靠任何港口,又返回始发港口的海上运输经营活动。

    本规定所称的多点挂靠业务,是指外籍邮轮在国际航线运营中,连续挂靠海南自由贸易港两个及以上邮轮港口,承载的旅客下船观光后在同一港口返回船舶,并完成国际海上运输的经营活动。经批准开展多点挂靠业务的经营者,不得承载自海南自由贸易港的一个港口登船、另一个港口离船的旅客。

    第三条 省人民政府交通运输主管部门和邮轮港口所在地人民政府交通运输主管部门对海上游业务和多点挂靠业务实施监督管理。

    外事、旅游文化、公安、商务(口岸)、食品安全监督管理、海关、边检、海事等部门和单位,按照各自职责做好相关监督管理工作。

    第四条 邮轮港口所在地人民政府应当加强对邮轮运输、旅游、娱乐、食品安全等领域监督管理工作的领导,落实邮轮发展保障措施,组织协调相关部门建立健全邮轮安全监管与服务保障管理机制,及时协调解决管理工作中的重大问题,做好应急体系建设以及相关突发事件的应急处置和舆情应对工作。

    第五条 经营海上游业务和多点挂靠业务的,应当符合下列条件:

    (一)经营者为依法设立的境内外企业,其中从事海上游业务的,中资(境内资本)出资比例不低于百分之五十一;

    (二)运营的邮轮与经营业务相适应,取得有效的船舶证书,且须符合国家规定的海上交通安全技术标准和有关船龄限制要求;其中从事海上游业务的,应当至少拥有或者光租一艘与经营范围相适应的邮轮;

    (三)拟停靠的码头应当符合港口运营有关法律、法规及技术标准的要求;

    (四)有客票;

    (五)按规定投保旅客人身伤亡责任保险;

    (六)法律、法规规定的其他条件。

    前款所述责任保险对每一名旅客人身伤亡的赔偿限额,应当不低于《中华人民共和国海商法》规定的旅客人身伤亡赔偿责任限额。

    第六条 经营海上游业务或者多点挂靠业务,应当向省人民政府交通运输主管部门提出申请,并提交符合本规定第五条规定条件的相关材料。省人民政府交通运输主管部门应当自受理申请之日起五个工作日内审核完毕,作出许可或者不予许可的决定。予以许可的,作出行政许可决定;决定不予许可的,应当书面通知申请人并告知理由。

    海上游业务经营者还应当在经营业务前两个月向省人民政府交通运输主管部门提出海上游运营航线方案申请。省人民政府交通运输主管部门收到申请材料后,会同省人民政府有关部门在五个工作日内提出初步审查意见,并征求有关方面意见后,依照有关规定报请批准。予以批准的,书面通知经营者;决定不予批准的,书面通知经营者并告知理由。

    经营者发生船舶、挂靠港口、班期变更或者运营航线变更的,应当向省人民政府交通运输主管部门提交相关申请材料并按本条第一款和第二款规定办理。

    申请人提交的相关材料为外文的,应当同时提供中文译本并对译文内容负责。

    第七条 邮轮运输经营者终止经营或者停开航线的,应当自情形发生之日起十五日内,向省人民政府交通运输主管部门备案。

    第八条 邮轮运输经营者应当遵守国家有关船舶安全和污染防治法律法规的规定,确保船舶安全营运和防止造成海洋环境污染。

    第九条 邮轮应当按照国家有关规定采取有效措施提高能效水平,靠港后应当按照国家有关规定使用岸电。具备岸电供应能力的港口经营人、岸电供电企业应当按照国家有关规定为邮轮提供岸电服务。

    第十条 邮轮运输经营者、旅行社应当以显著方式提醒旅客注意邮轮旅游安全注意事项、风险警示、民事责任与义务、免责事项、投诉电话、法律救助渠道等内容。

    鼓励邮轮运输经营者投保邮轮延误取消的相关保险。发生邮轮延误、取消、不能靠港、变更靠港等情况的,邮轮运输经营者、旅行社应当及时向旅客发布信息,告知解决方案。

    第十一条 邮轮进出口岸所在地人民政府应当建立口岸服务一站式运行协调机制,及时协调处理影响通关运行和效率的问题,减少旅客整体通关时间,促进旅客通关便利化。

    海事管理机构根据口岸查验需要,组织召集边检、海关等其他口岸查验机构对国际邮轮实施联合登临检查,提高邮轮出入境查验效率。

    海事、边检、海关等口岸查验机构应当优化邮轮进出口岸审批流程,优先办理邮轮进出口岸手续。

    边检机关应当综合运用互联网等技术手段,实现边检行政许可网上申请、审批、签发。

    第十二条 邮轮在海上遇险,应当立即向省海上搜救中心报告,并接受省海上搜救中心的统一组织指挥。

    省海上搜救中心应当完善邮轮大规模人命救助机制,加强搜救设施装备建设,提升救助能力。

    邮轮运输经营者以及邮轮应当与省海上搜救中心建立客船搜救合作计划,并定期组织开展演练。

    第十三条 各相关部门应当按照职责加强邮轮监督检查,建立违法经营行为监督举报和邮轮运输投诉处理机制,并接受社会监督。被检查单位和个人应当配合监督检查。

    第十四条 邮轮运输经营者依照本规定取得相应经营资格后,不再具备本规定第五条规定条件的,省人民政府交通运输主管部门应当取消其经营资格。

    邮轮运输经营者将其依法取得的经营资格提供给他人使用的,由省人民政府交通运输主管部门责令限期改正;逾期不改正的,撤销其经营资格。

    邮轮运输经营者未履行本规定第七条规定的备案手续的,由省人民政府交通运输主管部门责令限期改正。

    第十五条 邮轮运输经营者未经批准擅自经营海上游业务或者多点挂靠业务的,由省人民政府交通运输主管部门责令停止经营;有违法所得的,没收违法所得;违法所得五十万元以上的,处违法所得二倍以上五倍以下的罚款;没有违法所得或者违法所得不足五十万元的,处二十万元以上一百万元以下的罚款。拒不停止经营的,拒绝进港。

    第十六条 违反本规定的行为,本规定未设定处罚,其他法律、法规有处罚规定的,从其规定。

    第十七条 本规定自2025年1月1日起施行。


Several Regulations on Cruise Management of Hainan Free Trade Port

(Adopted at the 15th meeting of the Standing Committee of the Seventh People's Congress of Hainan Province on December 28, 2024)

    Article 1 In order to standardize the order of the cruise market in Hainan Free Trade Port and promote the safe and healthy development of the cruise economy in Hainan Free Trade Port, these regulations are formulated in accordance with the "Hainan Free Trade Port Law of the People's Republic of China", in accordance with the basic principles of the "Marine Law of the People's Republic of China", the "International Maritime Transport Regulations of the People's Republic of China", and the "Regulations on Domestic Water Transport Management", and in combination with the actual situation of Hainan Free Trade Port, these regulations are formulated.

    Article 2 Before the Five Star Red Flag Cruise is put into operation of maritime routes at the Hainan Free Trade Port Cruise Port, Chinese-funded cruise transport operators may carry out Chinese-funded Convenience Flag Cruise Marine Business (hereinafter referred to as maritime business) at the Hainan Free Trade Port Cruise Marine Port in accordance with these regulations. Foreign cruise ships can operate multi-point affiliation business (hereinafter referred to as multi-point affiliation business) involving only the Hainan Free Trade Port cruise port in accordance with these regulations.

    The maritime business referred to in these regulations refers to the maritime transportation business activities in which the Chinese-funded Convenience Flag cruise ship departs from Hainan Haikou and Sanya Cruise Ports and conducts maritime cruises within approved waters, and does not stop at any port and returns to the departing port during this period.

    The multi-point affiliation business referred to in these regulations refers to the fact that foreign cruise ships are continuously affiliated with two or more cruise ports in Hainan Free Trade Port during international route operation. The passengers carried by the carriers will return to the ship at the same port after disembarking from the ship to sightsee and complete the business activities of international maritime transportation. Operators approved to carry out multi-point affiliated business shall not carry passengers boarding the ship from one port of Hainan Free Trade Port or leaving the ship at another port.

    Article 3 The transportation department of the provincial people's government and the transportation department of the people's government where the cruise port is located shall supervise and manage the maritime business and multi-point affiliated business.
  
    Foreign affairs, tourism and culture, public security, business (port), food safety supervision and management, customs, border inspection, maritime and other departments and units shall carry out relevant supervision and management work in accordance with their respective responsibilities.

    Article 4 The people's government where the cruise port is located shall strengthen the leadership of supervision and management in the fields of cruise transportation, tourism, entertainment, food safety, etc., implement cruise development guarantee measures, organize and coordinate relevant departments to establish and improve cruise safety supervision and service guarantee management mechanisms, coordinate and resolve major problems in management work in a timely manner, and do a good job in emergency system construction and emergency response and public opinion response to related emergencies.

    Article 5: Those who operate offshore business and multi-point affiliated business shall meet the following conditions:

    (1) The operator is a domestic and foreign enterprise established in accordance with the law, and those engaged in offshore business shall have a contribution of no less than 51%;

    (2) The cruise ship operated is in line with the business, obtains a valid ship certificate, and must comply with the national maritime traffic safety technical standards and relevant age restrictions; among which, those engaged in maritime business, they should own or rent at least one cruise ship that is in line with the business scope;

    (III) The terminals to be docked shall comply with the requirements of relevant laws, regulations and technical standards for port operation;

    (IV) There are passenger tickets;

    (5) Insured in the casualty liability insurance for travelers in accordance with regulations;

    (VI) Other conditions stipulated by laws and regulations.

    The liability insurance mentioned in the preceding paragraph shall not be less than the liability limit for personal casualties compensation for personal casualties stipulated in the Maritime Law of the People's Republic of China.

    Article 6: When operating marine business or multi-point affiliated business, you must apply to the transportation authority of the provincial people's government and submit relevant materials that meet the conditions stipulated in Article 5 of these regulations. The transportation department of the provincial people's government shall complete the review within five working days from the date of acceptance of the application and make a decision to permit or not to grant permission. If a license is granted, an administrative licensing decision shall be made; if a decision is not given, the applicant shall be notified in writing and the reasons shall be notified.

    Overseas business operators shall also apply for an offshore operation route plan to the transportation authority of the Provincial People's Government two months before the business is carried out. After receiving the application materials, the transportation department of the Provincial People's Government shall submit preliminary review opinions in conjunction with the relevant departments of the Provincial People's Government within five working days and solicit opinions from relevant parties, and submit them for approval in accordance with relevant regulations. If the approval is made, the operator shall be notified in writing; if the decision is not approved, the operator shall be notified in writing and the reasons shall be notified.

    If an operator changes the ship, affiliated port, flight schedule or operating route, he shall submit relevant application materials to the transportation authority of the provincial people's government and handle the matter in accordance with the provisions of the first and second paragraphs of this article.

    If the relevant materials submitted by the applicant are in foreign languages, the Chinese translation shall be provided and responsible for the content of the translation.

    Article 7 If a cruise transport operator terminates its business or stops its route, it shall file a record with the transportation authority of the Provincial People's Government within 15 days from the date of the occurrence of the situation.

    Article 8 Cruise transport operators shall abide by the provisions of national laws and regulations on ship safety and pollution prevention and control, ensure the safe operation of ships and prevent marine environmental pollution.

    Article 9 Cruises shall take effective measures to improve their energy efficiency in accordance with relevant national regulations, and shall use shore power in accordance with relevant national regulations after they arrive at the port. Port operators and shore power supply enterprises with shore power supply capacity shall provide shore power services to cruise ships in accordance with relevant national regulations.

    Article 10 Cruise transport operators and travel agencies shall remind passengers to pay attention to the safety precautions of cruise tourism, risk warnings, civil liability and obligations, exemptions, complaint telephone numbers, legal assistance channels and other contents in a prominent manner.

    Cruise transport operators are encouraged to insure relevant insurance for cruise delay cancellation. If cruise delays, cancellations, inability to rely on ports, or change to rely on ports, cruise transport operators and travel agencies shall promptly release information to passengers and inform them of the solution.

    Article 11 The people's government where the cruise import and export shore is located shall establish a one-stop operation coordination mechanism for port services, coordinate and deal with issues that affect customs clearance operation and efficiency in a timely manner, reduce the overall customs clearance time for passengers, and promote the convenience of customs clearance for passengers.

    According to the needs of port inspection, the maritime management agency organizes and convenes other port inspection agencies such as border inspection and customs to implement joint boarding inspections on international cruises to improve the efficiency of cruise entry and exit inspections.

    Maritime, border inspection, customs and other port inspection agencies should optimize the approval process for cruise import and export shores, and give priority to the procedures for cruise import and export shores.

    Border inspection agencies should comprehensively use Internet and other technical means to realize online application, approval and issuance of border inspection administrative licenses.

    Article 12 When a cruise ship encounters danger at sea, it shall immediately report to the Provincial Maritime Search and Rescue Center and accept the unified organization and command of the Provincial Maritime Search and Rescue Center.

    The Provincial Maritime Search and Rescue Center should improve the large-scale life-saving mechanism for cruise ships, strengthen the construction of search and rescue facilities and equipment, and improve the rescue capabilities.

    Cruise transport operators and cruise ships should establish passenger ship search and rescue cooperation plans with the provincial maritime search and rescue center and organize drills regularly.

    Article 13 All relevant departments shall strengthen cruise supervision and inspection in accordance with their responsibilities, establish a mechanism for supervision and reporting of illegal business operations and handling complaints on cruise transportation, and accept social supervision. The inspected units and individuals shall cooperate in supervision and inspection.

    Article 14 If a cruise transport operator obtains the corresponding operating qualifications in accordance with these regulations and no longer meets the conditions stipulated in Article 5 of these regulations, the transportation authority of the provincial people's government shall cancel its operating qualifications.

    If a cruise transport operator provides the business qualifications obtained by law to others for use, the transportation department of the provincial people's government shall order the correction within a time limit; if the correction is not corrected within the time limit, the business qualification shall be revoked.

    If a cruise transport operator fails to perform the filing procedures stipulated in Article 7 of these Regulations, the transportation department of the provincial people's government shall order it to correct the problem within a time limit.

    Article 15 If a cruise transport operator operates offshore business or multi-point affiliated business without approval, the transportation department of the provincial people's government shall order it to stop the operation; if there is any illegal income, the illegal income shall be confiscated; if there is any illegal income of more than 500,000 yuan, the illegal income shall be fined not less than twice but not more than five times the illegal income; if there is no illegal income or the illegal income is less than 500,000 yuan, the fine of not less than 200,000 yuan and not more than one million yuan shall be imposed. Those who refuse to stop operating will refuse to enter Hong Kong.

    Article 16 If any act that violates these regulations does not impose a penalty on these regulations and other laws and regulations have provisions on penalties, the provisions shall follow.

    Article 17 These provisions shall come into force on January 1, 2025.
